These Terms of Use ("Terms") govern your use of the RealUniverse website at realuniverse.io (the "Site"). The Site is operated by FieldNow LLC ("FieldNow", "we", "us"), 4202 E Lamar Rd, Paradise Valley, AZ 85253. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. What the Site is
The Site gives general information about RealUniverse, PriceLock and related services and tools. It is not an offer to enter into any agreement. Using the Site or submitting a form does not create a contract, a client relationship or a project commitment.
2. Project commitments come only from a signed agreement
Any price, completion date, Daily Late Penalty, payment rule, verification step or other project commitment applies only as written in a signed agreement between the parties to that project. Words used on the Site to describe PriceLock, including "Guaranteed", "Price locked", "On time" and "On budget", summarize how the program is designed to work. They do not create any warranty or guarantee beyond the terms of your signed agreement. If anything on the Site conflicts with your signed agreement, your signed agreement controls.
3. Examples are illustrative
Project scenarios, sample project records, figures, dates and imagery on the Site are illustrative. They are not customer results, live product screens, quotes or predictions of any outcome.
4. Availability and services in development
RealUniverse is starting in Greater Phoenix, and Las Vegas is planned. Availability, PriceLock participation, project fit, funding arrangements and agreement terms must be confirmed for each project. Scorecards, Home Record, Concierge, Trusted Circles and the FieldOS tools described on the Site are in development and may change, be delayed or not be offered.
5. Independent professionals
Designers, architects, contractors, trade partners, inspectors, realtors and other professionals you may meet through RealUniverse are independent businesses. They are responsible for their own work, licenses, insurance and obligations. Except as set out in a signed agreement, FieldNow is not responsible for their services, advice, workmanship or conduct. You are responsible for your own decision about whom to work with.
6. Project funds
RealUniverse does not hold project funds. Any funding, custody or payment arrangement is with the provider identified in your signed agreement, on the terms stated there.
7. Partnerships and referrals
Any referral, compensation, fee or partnership arrangement is defined only in the applicable written partnership agreement. Nothing on the Site promises project volume, referrals or income.
8. No professional advice
Content on the Site is general information. It is not legal, financial, tax, insurance, engineering, architectural or construction advice. Please get advice from a qualified professional for your situation.
9. Information you send us
When you submit a form, you confirm that the information is accurate and that you are entitled to share it, and you agree that we may contact you about your inquiry. Please do not send sensitive information, such as bank details, card numbers or government ID numbers, through the Site. Our Privacy Policy explains how we handle your information.
10. Acceptable use
You agree not to:
use the Site unlawfully or to mislead anyone;
try to gain unauthorized access to the Site or its systems;
interfere with, disrupt or overload the Site;
scrape or copy the Site with automated tools, except as the law allows;
submit false information, or someone else’s information without their permission;
upload or transmit malicious code.
11. Intellectual property
The Site and its content, including text, design, graphics, images, and the RealUniverse, PriceLock and FieldOS names and logos, are owned by FieldNow or its licensors. You may view and print pages for your own personal, non-commercial use. Any other use requires our written permission.
12. Third-party links and services
Links to other websites are provided for convenience. We do not control them and are not responsible for their content or practices.
13. Disclaimer
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, FIELDNOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FIELDNOW AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED US $100.
This section does not limit liability that cannot be limited by law, and it does not change the terms of any signed project or partnership agreement.
15. Indemnity
You agree to indemnify and hold harmless FieldNow and its owners, officers, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your breach of these Terms.
16. Governing law and venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought only in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. The effective date above shows when they last changed. If you keep using the Site after a change, you accept the updated Terms.
18. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and FieldNow about your use of the Site. They do not replace any signed project or partnership agreement.
